These Terms of Use (“Terms”) govern your access to and use of the website www.cultivatingharmonytoday.com (the “Site”), including all content, services, tools, and products offered through the Site (collectively, the “Services”).
The Site is owned and operated by Cultivating Harmony LLC (“Cultivating Harmony,”"Cultivatingharmonytoday" “we,” “us,” or “our”), a Michigan limited liability company.
By accessing or using the Site or any Services, you agree to be bound by these Terms and our Privacy Policy and Disclaimer, which are incorporated by reference. If you do not agree, do not use the Site or Services.
1. Who We Are and What We Offer
Cultivating Harmony LLC operates a wellness practice centered on auricular acupuncture and related services, as well as an online store and educational content. Our offerings include, but are not limited to:
- In-person services (Troy, Michigan area):
- Auricular acupuncture sessions
- Ear seed sessions
- On-site auricular acupuncture and ear seed events for studios, salons, and workplaces
- Online store products:
- TCM charts and wall charts (e.g., seasonal qi and 24 Qi node calendar)
- Digital and print ebooks and guides
- Chinese Zodiac guides and related reference materials
- Other educational and reference products related to Traditional Chinese Medicine (“TCM”), wellness, and self-care
- Educational content:
- Blog posts and articles across three primary categories, including:
- Auricular acupuncture–focused content
- Ear seed therapy–focused content
- TCM insights, food energetics, and general wellness content
All Services and content are intended for informational and educational purposes only and are not a substitute for professional medical care.
2. No Medical Advice; No Provider–Patient Relationship
- Informational Only.
The content on this Site (including articles, blog posts, charts, guides, ebooks, and product descriptions) is provided for general informational and educational purposes only. Nothing on the Site is intended, and must not be taken, as medical advice, diagnosis, or treatment. - No Medical Provider–Patient Relationship.
Your use of the Site and viewing of content does not create a medical provider–patient relationship with Cultivating Harmony LLC or with any individual practitioner, including Daisy Harrison or any other provider affiliated with the practice. - Consult Your Healthcare Provider.
Always consult your physician, licensed acupuncturist, or other qualified healthcare professional regarding any medical condition, treatment, or health concern. Never disregard professional medical advice or delay seeking it because of something you have read on this Site or in our materials. - Emergency Situations.
If you are experiencing a medical emergency, call 911 or your local emergency services immediately. The Site and Services are not designed for crisis or emergency use.
3. Eligibility and Use of the Site
- Minimum Age.
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Site, purchase products, or book services. By using the Site, you represent and warrant that you meet this requirement. - Personal Use Only.
The Site and Services are provided for your personal, non-commercial use unless we expressly agree otherwise in writing. - Geographic Scope.
Our in-person services are provided in the Troy, Michigan area. Educational content and store products may be accessed and purchased from other locations; however, we do not represent that the Site or Services are appropriate or available in every jurisdiction. You are responsible for complying with all local laws that apply to you.
4. Booking Services and Appointments
- Scheduling.
You may request or book appointments for services such as auricular acupuncture, ear seed sessions, or on-site events through the Site or affiliated scheduling tools (e.g., third-party booking platforms). - Accuracy of Information.
When requesting an appointment, you agree to provide accurate, current, and complete information, including your contact details and any information reasonably requested for your care. - Cancellations and No-Shows.
Appointment cancellation and no-show policies, including any applicable fees, will be disclosed at the time of booking or in follow-up communications. By booking, you agree to those policies. - Right to Refuse Service.
We reserve the right to refuse or discontinue services where, in our reasonable judgment, it is unsafe, inappropriate, or outside our scope of practice.
5. Store Purchases and E-Commerce
- Product Descriptions.
We make reasonable efforts to describe our products accurately, including books, ebooks, charts, guides, and Zodiac materials. However, we do not warrant that descriptions, images, or other content on the Site are always complete, reliable, or error-free. Minor variations may occur. - Pricing and Availability.
Prices and availability are subject to change without notice. We reserve the right to correct any pricing errors and to refuse or cancel any order placed for an incorrectly priced item. - Orders and Payment.
By placing an order, you represent and warrant that you are authorized to use the payment method provided and that all information you submit is accurate and complete. We may use third-party payment processors and you agree to their terms in addition to ours. - Shipping and Delivery.
Shipping methods, fees, and estimated delivery times will be provided at checkout or in follow-up communications. Delivery times are estimates only and not guaranteed. - Digital Products.
For digital products (such as ebooks and downloadable guides), you will typically receive access via email or a download link after purchase. You are responsible for maintaining a backup of any digital files you download. - Refunds and Returns.
Our policies on returns, refunds, and exchanges for both physical and digital products will be stated on the Site or at the point of sale. By purchasing, you agree to those policies.
6. Intellectual Property Rights
- Ownership.
All content on the Site, including text, graphics, logos, images, charts, guides, downloadable materials, and the overall design and layout (collectively “Site Content”), is owned by or licensed to Cultivating Harmony LLC and is protected by copyright, trademark, and other intellectual property laws. - Limited License.

“Cultivating Harmony,” “Cultivating Harmony LLC,” and any associated logos, marks, or service names are trademarks or service marks of Cultivating Harmony LLC. You may not use these marks without our prior written permission.
7. User Conduct and Prohibited Uses
You agree not to use the Site or Services to:
- Violate any applicable law or regulation;
- Infringe upon the rights of Cultivating Harmony LLC or any third party;
- Interfere with or disrupt the operation or security of the Site;
- Attempt to gain unauthorized access to any part of the Site, other accounts, or computer systems;
- Transmit any viruses, malicious code, or other harmful material;

We may, in our sole discretion, terminate or restrict your access to the Site if we believe you have violated these Terms.

When you submit a message through a contact form, booking form, or email, you understand that we may use the information you provide to respond to your inquiry, manage appointments, and operate our business, in accordance with our Privacy Policy. - No Guarantee of Confidentiality.
While we take reasonable measures to protect your privacy, electronic communications via the internet may not be fully secure. Do not submit highly sensitive personal or medical information through the Site or email unless specifically instructed. - Testimonials and Feedback.
If you voluntarily submit feedback, reviews, or testimonials, you grant us a non-exclusive, royalty-free license to use, reproduce, and display that content (in anonymized or attributed form, as agreed) in connection with our business, subject to applicable law.

- Any particular result will be achieved from using auricular acupuncture, ear seeds, charts, guides, or other materials;
- The information on the Site is always complete, accurate, or up to date.
- Implied Warranties.
We expressly disclaim all implied warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- Exclusion of Damages.
Cultivating Harmony LLC and its owners, practitioners, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the Site or Services, including but not limited to loss of profits, data, or goodwill. - Cap on Direct Damages.
In no event shall our total aggregate liability arising out of or relating to the Site or Services exceed the greater of:
(a) the amount you paid directly to Cultivating Harmony LLC for the specific Service or product giving rise to the claim during the three (3) months prior to the event, or
(b) one hundred U.S. dollars (US $100). - Jurisdictional Limits.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the above limitations may apply to you only to the extent permitted by law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Cultivating Harmony LLC and its owners, practitioners, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or connected with:
- Your use of the Site or Services;
- Your violation of these Terms; or
- Your violation of any rights of a third party.
13. Changes to the Site or Terms
- Site Changes.
We may modify, suspend, or discontinue any part of the Site or Services at any time, with or without notice. - Changes to Terms.
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of the Site after any changes become effective constitutes your acceptance of the revised Terms.
14. Governing Law and Dispute Resolution
- Governing Law.
These Terms are governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. - Venue.
Any dispute arising out of or relating to these Terms, the Site, or the Services shall be brought exclusively in the state or federal courts located in Oakland County, Michigan, and you consent to the personal jurisdiction of such courts. - Time Limit for Claims.
Any cause of action or claim you may have arising out of or relating to these Terms or the Site must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently barred.
15. Miscellaneous
- Entire Agreement.
These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Cultivating Harmony LLC regarding the Site and Services and supersede all prior or contemporaneous understandings. - Severability.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. - No Waiver.
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. - Assignment.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations at any time as part of our business operations.
